【摘要】为了了解我国农村土地法律制度现状，宣传土地法律知识，课题组进行了大量的实地调查，发现在城市化扩张过程中存在大量亟待解决的“三农”问题，其中土地征收与房屋拆迁过程中失地农民合法权益受损问题尤为突出，它直接影响到整个农村大局的稳定、农业整体经济的发展和农民的生产生活，也影响了党和政府有关“三农”政策的落实。在目前大规模的城市化扩张与社会主义市场经济体制建构背景下，在政府大力推行经济刺激计划和拉动内需政策的引导下，有计划地践行“农业经济市场化、农村问题法制化、农民生活市民化”之“三化”有利于化解“三农问题”。【英文摘要】In order to understand current situation on the implementation of land law and regulations and publicize land law knowledge in the countryside in China, the project team of Heilongjiang University Law School conducted field surveys in Heilongjiang Province in 2008. It was found that there were more and more knotty issues related to the agriculture, countryside and farmers (Hereinafter called San-nong issues), especially the problem that farmers’ lawful rights and interests were seriously infringed in the process of land requisition and housing demolition and relocation. If such problems can not be solved properly, it will affect the stability of the countryside, overall development of the agricultural economy and farmers’ living as well as correct implementation of “San-nong policies”. Against the background of large-scale expansion of the urbanization and construction of the socialist market economy system and guided by the government’s policy of carrying out the economic stimulation plan and promoting the domestic demand, it is recommended that the “San-nong problems” be reduced and solved by sticking to the principles of rural market economy, the rule of law in addressing rural issues, and farmers’ living and status referring to urban residents in practice.【关键词】土地征收补偿；房屋拆迁补偿；“三农”问题【英文关键词】Compensation for land requisition; Compensation for housing demolition and relocation; Problems Related to the Agriculture, Countryside and Farmers (San-nong problems)【写作年份】2010年【正文】 　　《中共中央国务院关于2009年促进农业稳定发展农民持续增收的若干意见》明确规定：做好2009年农业农村工作，具有特殊重要的意义，扩大国内需求，最大潜力在农村；实现经济平稳发展，基础支撑在农业；保障和改善民生，重点难点在农民。并多次强调各级党委和政府坚持把解决好农业、农村、农民问题作为全党工作和政府全部工作的重中之重，切实加强和改善党对农村工作的领导，确保把党的各项农村政策落到实处。然而，在城市化扩张过程中产生了大量亟待解决的“三农”经济、政治、法律问题，直接影响到党和政府政策的落实。如何解决此类问题成为经济学、政治学乃至法学界面临的一项新课题。然而，“三农”问题的核心是土地问题，它是农业问题的基础、农村问题的根本、农民问题的根源。为了了解我国农村土地法律制度现状，宣传普及土地法律知识，推进我国土地法制改革进程，我们成立了以教授、硕士、博士研究生为主体的土地法律制度研究课题组，进行了为期一年的走访、发放问卷及访谈等实地调研，对立法机关工作人员、司法机关工作人员、农委、拆迁部门、土地管理部门、土地规划部门等执法工作人员、市民、农民等数百人进行面对面的接触和交流，较为全面地听取他们关于土地法律制度问题的意见和建议，并对调研数据进行了全面的对比梳理、分析及总结，发现农村土地问题以及由土地征收而引发的“三农”问题依然比较严峻。农村仍然是被法制春天遗忘的角落。
